RALEIGH, (AP) — A North Carolina appeals court has overturned a Durham judge's decision to throw out the murder charges facing a man who spent 12 years in prison because of problems with the state's crime lab.
The state Court of Appeals said Tuesday it agrees with the displeasure of Superior Court Judge Orlando Hudson on how blood testing results were shared with attorneys for Derrick Allen and with prosecutors. But the court says it doesn't agree with Hudson's reasoning in throwing out Allen's child murder charges. The court ordered a new hearing.
Hudson dismissed murder and assault charges against Allen in 2010. He was serving a prison sentence for the 1998 death of his then-girlfriend's 2-year-old daughter. Hudson said it's no longer possible for Allen to get a fair trial.
