ATLANTA (AP) — A Kuwaiti military food supplier facing federal fraud charges has filed a $225 million claim against a U.S. agency it contends breached the terms of a contract.

Agility, also known as The Public Warehousing Co., said this week that employees of the U.S. Defense Logistics Agency and the Justice Department conspired to deprive the company of its rights to deliver food to troops in the Middle East.

The company said the complaint was filed at the Armed Services Board of Contract Appeals in Virginia.

Prosecutors in Atlanta charged the company in November 2009 with manipulating a funding formula to defraud the U.S. government of at least $68 million in contracts to supply troops in Iraq, Kuwait and Jordan. The company has asked a judge to dismiss the charges.
